Terms of Use — Let's Tour

These Terms of Use (“Terms”) govern your use of the Let's Tour mobile application (the “App”), provided by Roman Okulevich, an individual based in Spain (“we”, “us”, “our”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 14 years old (the age of digital consent in Spain) to use the App. If you are under the age of majority in your country, you confirm that a parent or guardian agrees to these Terms.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use, subject to these Terms and to Apple's licensing rules. You may not copy, modify, reverse-engineer, resell, or exploit the App except as permitted by law.

3. The service

Let's Tour generates personalized walking tours based on your location and preferences, offers a library of pre-generated and hand-curated “Golden Tours”, and lets you save, schedule, and share tours. Features may change, be added, or be removed over time.

4. Subscriptions, billing & free trial

The App offers auto-renewable subscriptions that unlock unlimited generated tours and the full Golden Tours library. Consistent with Apple's rules:

• Plans: weekly, monthly, and annual subscriptions. The exact title, duration, and price of each plan are shown in the App and on the App Store before you purchase.
• Free trial: new users get a free trial. If you buy a subscription during a trial, any unused portion of the trial is forfeited. The free trial lasts 7 days.
• Payment: payment is charged to your Apple ID account at confirmation of purchase.
• Auto-renewal: your subscription automatically renews unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price of your selected plan.
• Managing & cancelling: you can manage or cancel your subscription in your Apple ID Account Settings after purchase. Cancelling stops the next renewal; the current period is not refundable except where required by law.
• Refunds: purchases are handled by Apple. Refund requests are managed by Apple via its standard process. EU consumers retain any statutory withdrawal/refund rights.

5. Acceptable use

You agree not to: use the App unlawfully; interfere with or disrupt the App or its servers; attempt to access data that is not yours; use automated means to scrape or overload the service; or use the App in any way that infringes others' rights.

6. User content

If you save or share tours or other content, you remain responsible for that content and grant us a limited license to host and display it solely to operate the App's sharing features. Do not share content that is unlawful or infringes others' rights.

7. AI-generated content & safety — please read

Tours, routes, descriptions, and tips are generated automatically (including by AI) and drawn from third-party data. They may be inaccurate, incomplete, or out of date, and are provided for general informational purposes only — not professional travel, safety, legal, or navigational advice.

Use common sense and stay safe. Always:

• Be aware of your surroundings and traffic; do not stare at your phone while walking.
• Follow local laws, signage, opening hours, and access restrictions.
• Verify safety conditions, neighborhood advisories, and venue details independently.
• Take responsibility for your own route choices and well-being.

We are not responsible for closures, errors, third-party places, or any decision you make based on a generated tour.

8. Intellectual property

The App, its software, branding, and the Golden Tours editorial content are owned by us or our licensors and are protected by law. Place names, photos, and facts about third-party locations belong to their respective owners.

9. Disclaimers

The App is provided “as is” and “as available”, without warranties of any kind to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that generated tours will meet your expectations. Nothing in these Terms limits mandatory consumer rights you have under Spanish or EU law.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss arising from your use of, or reliance on, generated tours. Nothing here excludes liability that cannot be excluded by law (including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights).

11. Termination

We may suspend or terminate your access if you breach these Terms. You may stop using the App at any time; subscription terms in Section 4 continue to apply to any active subscription.

12. Apple's standard EULA

If we do not provide a separate end-user license agreement, Apple's standard Licensed Application End User License Agreement applies to your use of the App: apple.com/legal/internet-services/itunes/dev/stdeula. Apple is not a party to these Terms and is not responsible for the App, but is a third-party beneficiary entitled to enforce these Terms against you.

13. Governing law

These Terms are governed by the laws of Spain, without prejudice to mandatory consumer-protection rights in your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr).

14. Changes

We may update these Terms. For material changes we will provide notice in the App or on letstour.app and update the “Last updated” date. Continued use means you accept the updated Terms.
